Use of this website
You may only use this website for lawful purposes. You are prohibited from all manner of usage that may violate the rights of any third party.
You recognise and agree that the content contained within this website is only intended for your own personal, non-commercial use and you may only download, print or use content for this purpose.
Unless you have prior consent from us in writing, you must not copy, reproduce, modify, distribute, imitate, publish, commercially exploit or link to or deep-link into this website.
Chargebacks on Card Payments
When a payment is made to us via a credit or debit card, we expressly reserve our right to assume that the person transacting with us has the authority of the cardholder to enter into the transaction on the cardholder’s behalf.
In the event that the credit or debit card payment is cancelled, retracted, challenged or altered after purchase, regardless of the reason, we reserve our right to payment in full along with any additional costs we incur as a result of that action by the cardholder.
We expressly disclaim any liability (including in negligence) in the event that a credit or debit card is used without the cardholder’s permission. You acknowledge and agree that this term is reasonably necessary to protect us from the risk of loss, including loss of goods, costs, and profit
Item availability
We will use our best endeavours to ensure items ordered are available for delivery and in most cases, we will notify you where an item is unavailable prior to you completing your order. In some cases, this is not possible and we may need to reject an order you have placed for an item where we establish that it is unavailable for delivery.
Payment
All orders are calculated in Australian Dollars (AUD). You must pay for your items purchased on this website at the time of placing an order.
We will always act to protect the details of your payment and purchase however in the absence of negligence, Sportz Design will not be responsible for any loss or damage that you may suffer if a third party acquires unauthorised access to data that you have provided to us when ordering from our website.

You acknowledge and agree that by using any third party payment services such as PayPal you are bound by the terms and conditions of that third party and that we are not liable for any loss, claims or damages howsoever arising in connection with that third parties services.

We may change or update this website and the terms and conditions at any time by giving you notice as outlined below. Your use of this website after notice will constitute your deemed acceptance of such changes.
Termination
If you breach these terms and conditions, we reserve the right to immediately suspend, terminate or limit your access to this site.
Release and Indemnity
Sports Design provides goods and services from third-party providers and manufacturers. Sports Design makes no warranty in respect to these goods and services, to the extent that can be excluded by Australian Consumer Law.
In ordering goods and services through Sportz Design you release from liability and hold harmless Sportz Design our affiliates and our and their employees.

Sportz Design makes no warranties or representations about this website or any of the content, accepts no responsibility for any loss suffered by you or anyone else in connection with the use of this website or content and does not guarantee that this website will not cause damage or is free from viruses or any other defects or errors.
We exclude, to the maximum extent permitted by law, any liability which may arise as a result of the use of this website or the content contained within it.
We will not be held responsible or liable for any direct or indirect loss or damages caused or alleged to have been caused by your use, of, or reliance on, any content, goods or services available on an external site.

Online shopping
When placing information onto our website, we will take reasonable care in ensuring that all details, prices, item images and descriptions displayed are correct at the time.
While we have made every attempt to show textures, appearances, and colours of our items as accurately as possible, what you see will vary depending on your monitor and computer equipment. We cannot guarantee that the item images are an exact representation of the actual items.

Refund Policy
At Sports Design we try extremely hard to ensure that our artwork is accurate and to the highest standards.
We take pride in setting high-quality design standards.
We ask that you take the time to view the artwork sent for your approval as Sports Design will not be liable for any mistakes found after production which has been approved by the customer on the Artwork Proof.
While we strive to provide the highest quality in all of our products, sometimes there can be a manufacturer’s faults. We can either replace the item in full or offer a refund.
We cannot offer a refund on the 'custom design fee' or 'delivery' fee once the item has been produced and shipped. Once you have placed your order you have entered an agreement to these terms.
Claims must be made within 1 calendar week of receiving your product, and an outcome agreed upon by both parties within 2 weeks of complaint received.
Orders
We reserve the right to accept or reject an order for any reason due to unavailability of item; an error in the price, image or the item description or error in your order.
We further reserve the right to limit sale to some areas at our discretion. For further details please see our Delivery and Shipping Policy and Warranty and Returns policy.
We reserve the right to contact you for verification purposes before we allow your order to be dispatched.
Changing or Cancelling an order
Sports Design accepts no responsibility for orders you have placed incorrectly. This includes incorrect product size orders. Once you have placed your order online it will not be possible to change or cancel as we place your orders with third-party manufacturers and providers immediately.

PRE-ORDERs
In pre-ordering, you are able to reserve an item for an upcoming stock order. Payment is required in full at the placement of order.
The arrival date of a pre-order is listed on each item description page. These dates reflect the projected date at which we will receive the stock of the item and commence shipping from that date.
The pre-order period will conclude a few weeks before we are due to receive the stock, or once all the pre-orders are sold out. pre-order pricing is subject to change and we will not refund money or offer refunds for price changes.
All quoted dates are estimates only. We will keep our customers updated via email through the pre-order period and closer to the arrival dates.
Delivery
The delivery fee is non-refundable unless the goods fail to comply with the consumer guarantee provisions of the Australian Consumer Law.
We will only deliver to addresses within Australia and reserve the right not to deliver is specified areas. Delivery time will vary depending on your location and the size of your order.
We will make every attempt to deliver goods within the estimated timeframe however delays may occur due to unforeseen circumstances or factors outside our control. We may also from time to time ship items separately and we make no guarantee items or item components will be shipped together.
We can accurately predict when your goods will leave our factory, however after goods have left our factory, the responsibility becomes that of the postal services.
Sports Design take no responsibility for deliveries that are late due to courier delays.
To ensure you have your products on time, please order well in advance and inform your sales representative of your event date.
